This Scheme (hereinafter referred to as the “Scheme”) is promoted/organized by TAXSMILE.COM India Private Limited (hereinafter referred to as “Taxsmile”) subject to the Terms and Conditions mentioned hereinafter. Under the Scheme winner will be selected amongst Participants by automated luck draw and lucky winners can win Gold Coin of a denomination of 2.5 gms (hereinafter may also be called “Prize” or “Product “) Taxsmile in its absolute discretion reserves the right to add, alter, modify, change or vary, all or any of these Terms & Conditions, wholly or in part, at anytime without giving any prior notice and the participant/contestant/winner agrees to abide by such additions, alterations, modifications and changes. If you do not agree to the terms mentioned herein you are not eligible to participate in the Scheme.

1. This is not a lottery Scheme.
   
   
2. Offer is valid during the “Offer Period” which shall be from 1st July 2009 to 31st July 2009(both days inclusive).
   
   
3. All the Subscribers of TAXSMILE GOLD subscribing during the Offer Period shall be eligible participate in the Scheme and shall be called “Participants” hereinafter. All Participants shall be bound by the Terms and Conditions mentioned herein and as may be amended from time to time.
   
   
4. This Scheme is valid within India only.
   
   
5. The visuals shown are indicative and may differ from the actual product. The images are for representation purpose only.
   
   
6. The draw will be held every Monday at with the customer list taken on the 1st come 1st serve basis for customers who have subscribed from Monday to Sunday the draw will be for a lot of every 1000 customers who subscribe for TAXSMILE GOLD in the above period.
   
   
7. Customers who do not fall in the 1000 count in a week will be carried forward to the next draw cycle i.e. In case the total subscribed base from Monday to Sunday is for example is 15453 then 453 customers (not in multiples of 1000) will be carried forward to the next cycle. As per this example total draws become 15.
   
   
8. List of Winners will be announced as when and we run the draw.
   
   
9. Taxsmile shall not take any responsibility of the quality and accuracy of the product and shall not be held liable in any way for the prize product being deficient or defective or damaged/ lost in transit.
   
   
10. Delivery will be made to the address specified by buyer when the buyer registers on the website. Taxsmile shall not be responsible for any delivery failure on account of false, inadequate or improper address mentioned by the winner.



11. Taxsmile may, at its discretion, procure Gold Coins or Vouchers from reputed vendors and deliver it to the Winners announced by Taxsmile. In case of Vouchers, the details of the vendor i.e. names and locations (Designated Vendor) for redemption of such Vouchers may be communicated to the Winners. Winner shall visit Designated Vendor location and collect Prize by redeeming the Voucher. Winner acknowledges that in case of Bearer Voucher, Taxsmile shall not be responsible and liable for any claims/losses of whatsoever nature, as may be suffered by the Winner including the losses, claims arising out of theft, damage or any defect, mishandling etc with respect to the said Voucher, whether the same is incurred with or without any fault on the part of the Winner.



12. Winner shall bear all costs directly arising or incidental for the collection of prize Taxsmile shall endeavor that the deliveries are made within the specified delivery period. Winner shall ensure that an appropriate person is available at the delivery address on the specified day to collect the product / gift / prize, failing which Taxsmile shall not be responsible for any delivery failure.



13. Prize or Product on offer shall neither be transferable nor can be exchanged for cash or otherwise. However, Taxsmile may at its absolute discretion, permit exchange of Prize with any other form which may or may not equivalent to the Prize offered under the Scheme.



14. Gold Coins / Vouchers shall be procured at the end of the Offer Period after ascertaining the actual count required and will be distributed to the winners after the end of the Offer Period.



15. Employees of Taxsmile, 3i Infotech Ltd and its subsidiaries are also eligible to participate in the Program since it is a draw for the paid customer base for TAXSMILE GOLD.



16. Taxsmile shall not be responsible for any postal delays, transit losses.



17. Taxsmile officials or its vendors engaged in the organization and management of the Scheme, including its directors, officers, partners, employees, consultants and agents are under no obligation to render any advice or service to any person in respect of the Scheme.



18. No responsibility is accepted for late registration.



19. Participation in the Scheme shall be construed as an acceptance of the Terms and Conditions stipulated herein. Any breach or default by a Participant of any of the Terms and Conditions herein shall result in immediate disqualification of His / Her without notice.



20. Taxsmile reserves its absolute right to withdraw and/or alter any of the terms and conditions of this offer at any time without prior notice.



21. Winners will be decided by the lucky draw method which shall be final and binding upon the participants/winner.



22. Winner agrees to his/her name being published in the newsletters, websites or any other media.



23. Taxsmile shall not be liable for system/server failures or any other technical failure. Taxsmile shall not be held responsible for any failure to fulfill the obligations of any of the third parties involved in the scheme.



24. Taxsmile reserves the right, without prior notice, to access, read preserve and/or disclose the personal information of the participant if the same is required for the limited purpose of scheme or in order to comply with any provision / requirement of Law or any court judgment / decree / order / directive by any legal / government authority.


25. Taxsmile reserves the right to store and process the personal information provided by the participant/winner in India or any other country where Taxsmile or its agents/representatives/group companies maintain storage and processing facilities and the participant by using the services herein consents to any such transfer of information outside India without prior notice.



26. Taxsmile reserves the right to change the timing/dates/hours/duration of the scheme without any prior intimation to the participants



27. Taxsmile will in no way be responsible for circumstances beyond its control, which may hinder the completion of the scheme


28. Prize winners are fully responsible for the taxes and levies on winnings as may be imposed by Central,& State Governments and any other Statutory authorities from time to time



29. The winners shall be required to produce all the documents as required by Taxsmile to the satisfaction of Taxsmile in order to claim the prize



30. Originals of the documents should be made available to Taxsmile for verification at any time before the prize is given, if so insisted upon by Taxsmile .



31. Only the winners shall be informed by Taxsmile in such manner as may be decided by Taxsmile from time to time. If informed via email, return of any email notification as undeliverable or failure by the winner/participant to reply as specified in the email within the time stated therein shall result in disqualification.



32. The mode of delivery of the prizes, shall be conveyed to the winners, separately.



33. Participants shall provide their PAN no, where ever needed, as the Winner(s) shall be liable to bear an amount equivalent to Tax Deducted at Source (TDS) as may be applicable from time to time. The prize is subject to Income Tax as per I.T. Act and any other applicable taxes as per prevailing income tax law



34. Though Taxsmile shall make every effort to declare the results of the contest on the due date/hour, it shall not be responsible for any delay in announcing the winner(s) due to any reasons beyond its control.



35. In the event of any winner choosing not to accept a prize(s) or forfeit any and/or all claims qua the prize or if Taxsmile is unable to reach/contact the winner, Taxsmile shall have the absolute discretion to deal with such prize as it deems fit and/or select an alternative winner



36. No correspondence will be entertained with regard to this Lucky Draw



37. Participants/winners may be required by Taxsmile to participate in a photo, video and/or film session and acknowledge that Taxsmile may use such publicity photos, videos and/or films in any medium and in any reasonable manner it may deem fit for the limited purpose of contest or as mentioned herein above



38. Taxsmile in its absolute discretion may publicize, upload, broadcast or otherwise disclose a participant’s/winner’s name, particulars, likeness, statements or any recording of their voice in advertising or promotional activities concerning this scheme, or generally. Taxsmile shall not be responsible for any loss or damage suffered by the winner while participating in the Scheme



39. This offer cannot be clubbed with any other offer



40. Taxsmile in its absolute discretion reserves the right to add, alter, modify, change or vary all or any of these Terms & Conditions, wholly or in part, at anytime without giving any prior notice and the participant/winner agrees to abide by such additions, alterations, modifications and changes



41. Taxsmile reserves the right to extend or to cancel, or change the manner in which the Scheme is organized or discontinue or terminate the scheme at any time or to accept or reject any or all entries at their absolute discretion without giving any prior notice and without assigning any reason whatsoever.



42. Failure by Taxsmile to enforce any of these Terms & Conditions in any instance(s) shall not give rise to any claim by any person.



43. Any attempt by a participant to deliberately damage or undermine the legitimate operation of the activity is a violation of Criminal and Civil Laws and should such an attempt be made, Taxsmile reserves the right to seek damages from any responsible person to the fullest extent permitted by law.



44. All Participants and winners waive any and all rights of claim against Taxsmile, with regard to this Scheme.



45. Taxsmile shall conduct automated lucky draw to select the winners from amongst the participants. The decision of Taxsmile in this matter will be final and binding and no questions, correspondence, enquiries, etc. on the manner of conduct of the lucky draw and the Contest itself from any party whatsoever will be entertained.



46. Taxsmile reserves the right to cancel any part or all of the prizes.



47. Mere participation in this Scheme does not entitle you to win a Lucky Draw prize.



48. All matters with respect to the Scheme are subject to the jurisdiction of the Courts at Bangalore only.



49. Terms and Conditions of eMudhra Digital Signature Certificate and Taxsmile are applicable to the Contest.



50. By subscribing to or using any of services/contest, Participants agree that they have read, understood and are bound by the terms and conditions set out herein.
